A BILL TO BE ENTITLED
ANACT
relating to state preemption of certain municipal and county
regulation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1.AAThis Act shall be known as the Texas Regulatory
ConsistencyAct.
SECTIONA2.AAThe legislature finds that:
(1)AAthe State of Texas has historically been the exclusive regulator of many aspects of commerce and trade in this state;
(2)AAin recent years, several local jurisdictions have sought to establish their own regulations of commerce that are different than the state ’s regulations; and
(3)AAthe local regulations have led to a patchwork of regulationsacrossthisstatethatprovideinconsistency.
SECTIONA3.AAThe purpose of this Act is to provide regulatory consistency across this state and return the historic exclusive regulatorypowerstothestatewherethosepowersbelong.
SECTIONA4.AAChapter 1, Agriculture Code, is amended by addingSection1.004toreadasfollows:
Sec.A1.004.AAFIELD PREEMPTION. The provisions of this code preclude municipalities or counties from adopting or enforcing an ordinance, order, rule, or policy in a field occupied by a provision of this code unless explicitly authorized by statute. A

5 CHAPTER 102A. MUNICIPAL AND COUNTY LIABILITY FOR PREEMPTED
6 REGULATION
7 Sec.A102A.001.AALIABILITY FOR CERTAIN PREEMPTED REGULATION.
8 Anyperson,includingataxpayer,adverselyaffectedbyamunicipal
9 orcountyordinance,order,rule,orpolicyadoptedorenforcedby
10 a municipality, county, municipal official or county official
11 acting in their official capacity in violation of any of the
12 followingprovisionshasstandingtobringandmaybringanaction
13 againstthemunicipality,countyorofficial:
14 (1)AASection 1.004, Agriculture Code;
15 (2)AASection 1.004, Finance Code;
16 (3)AASection 30.005, Insurance Code;
17 (4)AASection 1.005, Labor Code;
18 (5)AASection 1.003, Natural Resources Code; or
19 (6)AASection 1.004, Occupations Code.
20 Sec.A102A.002.AAREMEDIES. A claimant is entitled to recover
21 inanactionbroughtunderthischapter:
22 (1)AAdeclaratory and injunctive relief; and
23 (2)AAcosts and reasonable attorney’s fees.
24 Sec.A102A.003.AAIMMUNITY WAIVER AND PROHIBITED DEFENSES.
25 (a) Governmental immunity, official immunity, and qualified
26 immunity, as applicable, are waived to the extent of liability
27 createdbythischapter.

S.B.ANo.A814 (b)AAOfficial and qualified immunity may not be asserted as
adefenseinanactionbroughtunderthischapter. Sec.A102A.004.AAVENUE. Notwithstanding any other law,
including Chapter 15, a claimant may bring an action under this chapter in any county in this state. If the action is brought in a venue authorized by this section, the action may not be transferred to a different venue without the written consent of all parties.
Section 102A.005. PERSON. For purposes of this section "person"meansanindividual,corporation,businesstrust,estate, trust, partnership, limited liability company, association, joint venture, government, governmental subdivision, agency or instrumentality, public corporation, or any legal or commercial entity, or protected series or registered series of a for-profit entity.
SECTIONA6.AAChapter 1, Finance Code, is amended by adding Section1.004toreadasfollows:
Sec.A1.004.AAFIELD PREEMPTION. The provisions of this code precludemunicipalitiesandcountiesfromadoptingorenforcingan ordinance, order, rule, or policy in a field occupied by a provision of this code unless explicitly authorized by statute. A municipalorcountyordinance,order,rule,orpolicythatviolates thissectionisvoidandunenforceable.
SECTIONA7.AAChapter 30, Insurance Code, is amended by adding Section30.005toreadasfollows:
Sec.A30.005.AAFIELD PREEMPTION. The provisions of this code precludemunicipalitiesandcountiesfromadoptingorenforcingan ordinance, order, rule, or policy in a field occupied by a

23 precludemunicipalitiesandcountiesfromadoptingorenforcingan
24 ordinance, order, rule, or policy in a field occupied by a
25 provision of this code unless explicitly authorized by statute. A

27 thissectionisvoidandunenforceable.

1 SECTIONA11.AAChapter 102A, Civil Practice and Remedies Code,
2 asaddedbythisAct,appliesonlytoacauseofactionthataccrues
3 onoraftertheeffectivedateofthisAct.
4 SECTIONA12.AAThis Act takes effect immediately if it
5 receives a vote of two-thirds of all the members elected to each
6 house,asprovidedbySection39,ArticleIII,TexasConstitution.
7 If this Act does not receive the vote necessary for immediate
8 effect,thisActtakeseffectSeptember1,2023.
